How else can the MDA fight something like the EAB?

There is another law. Act 72 of 1945. It is very similar to Act 189, and when reading the two acts it almost sounds like they are both covering the same things, but they are not. By the way, the MDA doesn't like to talk about act 72 any more than they have to. That's because Section 5 of Act 72 says that the MDA is not permitted to cut down infested trees until they first treat them with approved remedies, if that is feasible. And further, if they cut down any trees which are found to have NOT been infested, they have to pay the owner for the actual value of the tree. Now that makes sense. If a tree is infested try to save it. If it can't be saved, take it down. If you take down a tree that isn't infested, either by mistake, or because you think it might protect someone else's ash tree, then pay that person for the value of the tree.
